> There is no set length. A claim usually moves through treatment, gathering records, a demand, negotiation and, if needed, a lawsuit. The one fixed point is the filing deadline, so the clock matters even while you are still talking to the insurer.

Waiting is hard when bills are coming in. No one can tell you exactly how long your claim will take. Here are the usual stages, so you know where you are.

## What are the stages?

1. **Treatment.** You get care and follow your doctor's plan.
2. **Records.** You gather medical records, bills, the crash report and photos.
3. **Demand.** A written request for compensation goes to the insurer.
4. **Negotiation.** You and the insurer exchange offers.
5. **Settlement or lawsuit.** You either reach an agreement or file a lawsuit before the deadline.

### What each stage looks like

| Stage | What happens | What you do |
| --- | --- | --- |
| Treatment | Care continues; bills arrive | Follow your doctor's plan; keep a pain and symptom log |
| Records | Providers send records; the report is available | Gather and organize; see [your crash report](https://roanokecrashhelp.com/roanoke-crash-report/) |
| Demand | A written request is sent to the insurer | Review it before it goes out |
| Negotiation | Offers go back and forth | Keep calls factual; see the [adjuster guide](https://roanokecrashhelp.com/insurance-adjuster/) |
| Settlement or suit | An agreement, or a court filing | Check your dates; read anything before you sign |

## What slows a claim down?

Anything that makes the facts unclear or the amounts uncertain can add time. Examples:

- treatment that is still going on
- missing records or a missing crash report
- disagreement about fault. Virginia's [contributory negligence rule](https://roanokecrashhelp.com/contributory-negligence-virginia/) can make that a bigger issue
- more than one insurer or more than one driver
- a government body involved, which needs written notice first
- liens or repayment claims from health plans; see [who pays medical bills](https://roanokecrashhelp.com/who-pays-medical-bills/)

## Which court would hear a lawsuit?

Virginia's general district court has exclusive civil jurisdiction up to $4,500 for money claims, including "any action for injury to person." Between $4,500 and $50,000, the general district court and the circuit court can both hear a case ([§ 16.1-77](https://law.lis.virginia.gov/vacode/title16.1/chapter6/section16.1-77/)). Confirm the current amounts with the court or a lawyer.

## What is the one date that doesn't move?

The filing deadline. A statute of limitations is a law that sets the last day to file a lawsuit. For injury, Virginia's general limit is two years after the claim accrues ([§ 8.01-243](https://law.lis.virginia.gov/vacode/title8.01/chapter4/section8.01-243/)), and property damage is five years.

If a city, county, town or the state may be at fault, written notice comes first. It is due within six months for a locality ([§ 15.2-209](https://law.lis.virginia.gov/vacode/title15.2/chapter2/section15.2-209/)) and within one year for the Commonwealth ([§ 8.01-195.6](https://law.lis.virginia.gov/vacode/title8.01/chapter3.2/section8.01-195.6/)).

## Common questions

### Why is the insurer taking so long?

There is no single reason. Insurers may be waiting on records, reports or a decision from someone else. Follow up in writing, keep copies, and note dates. Your filing deadline keeps running while you wait, so check it with our free deadline checker.

### Should I settle before I finish treatment?

Think carefully before you do. An early offer may come before you know the full extent of your injuries and bills, and a signed release can end your claim. This is a practical caution, not legal advice. Ask your doctor about your recovery, and consider asking a lawyer to review any offer.

### What happens if we can't agree?

If you and the insurer cannot agree, you may file a lawsuit before the deadline runs. The court that hears it depends partly on the amount claimed. After a suit is filed, the case follows court steps and dates. A lawyer can explain the process and what to expect for your case.

### What is a demand letter?

A demand letter is a written request, usually sent to the insurer, that describes the crash, your injuries and bills, and asks for compensation. It is often the start of negotiation. A lawyer can prepare one for you and explain what it should include.
